There are several debates going on in the Illinois license reinstatement field as to how long the new law that goes into effect on January 1, 2016 will require people who are getting their license back to be on the restricted driving permit with a BAIID device. For example, currently a person who has had two DUI arrests will be required to be on a restricted driving permit for one year and after that successful restricted driving permit has been complied with they will be eligible for a full reinstatement hearing after that year. The question is whether the new law will require a person with two DUI convictions to be on a five-year restricted driving permit.
In speaking with several experts in the field as well as some hearing officers I feel when I Secretary of State, it seems that the interpretation for people with two DUIs will still be eligible for one year on the restricted driving permit and will not be extended for five years. Well I can guarantee that this is accurate it seems to be the consensus at this point and I will keep you updated when I find out how the lot is being treated after January 1, 2016.
