Interstate Driver’s License Compact Pact: What happens to my Illinois Driver’s license if I get a DUI in another state?

The Interstate Driver's License Compact is an interstate compact among 45 states, in which the participating states agree to honor each other's driver license suspension requirements and notify the state you are licensed in of your DUI conviction or refusal to take a breathalyzer. If you've been arrested and convicted in any one of the 45 participating states, your suspension and conviction will stand in other states as well. Michigan, Wisconsin, Georgia, Massachusetts, and Tennessee are not members of the Interstate Driver's License Pact.

For instance, under The Interstate Driver's License Compact, if you have an Illinois Driver's License and get a DUI or refuse a breathalyzer in Indiana, the Secretary of State will automatically revoke your Illinois license once the out-of-state court reports the conviction. It typically takes approximately two weeks for your out-of-state conviction to reach the Illinois Secretary of State office. Once your license has been revoked, you will receive notice shortly via mail. Illinois will place a hold on your license with the revocation and you cannot go to another state and apply for a license.

DUI's fall within the scope of a State's police power and every state has its own DUI statutes. Illinois will only take action against your Illinois Driver's License, but you will be criminally punished in the state you received your DUI in.
