Technically, an out of state dui license client is seeking full reinstatement or clearance of his driver's license. Filling out and mailing in the out of state hearing packet is worthless in my opinion because the Secretary of State of Illinois is not looking for explanations as to why you have not received a DUI in the past few years, they want to know facts. Facts about what you were drinking on the night of your DUIs. Facts about your drinking pattern in the years prior to you DUIs and after your most recent DUI. And facts about symptoms of dependence and abuse. If you don't have the right answers for the Secretary of State hearing, you will be denied.
I have developed a worksheet that helps my clients prepare for the Secretary of State hearing. This allows me to prepare their testimony so that it is truthful, consistent with what the Secretary of State is looking for and gives the client a chance to know the questions they will be asked at the formal administrative hearing.
