Difference in Testimony between Level 2 Significant and Level 3

As a lawyer who handles license reinstatements for many clients from inside and outside the State of Illinois, many people want to know what the questions at the formal administrative hearing will be after they finally receive a fixed date for the hearing.

It depends… If you are a Level 2 Significant risk classification, you will be asked questions specifically about your drinking pattern from 12 months prior to your first DUI all the way up through your last DUI until current. The answers must be very detailed. For example, “I drank a couple of times a week.” will not cut it. The Illinois Secretary of State is looking for something much more specific. “1-2 times per week, 3-4 beers per occasion, with once every 2-3 months up to 8 beers” is the level of detail the hearing officer is looking for.

A level 3 dependent only needs to define the drinking pattern as far back as twelve months prior to the last DUI up until the current day. Obviously, I sounds like the level 3 has an easier time of it, but you should remember that the level 3 candidate needs to know the details of the AA program or whatever support group he or she is utilizing.
