As an attorney who handles any license reinstatement matters where a client is revoked for DUI in Illinois, an interested scenario just popped up…
I recently had a situation where I performed a formal license reinstatement hearing for with the Secretary of State. In between the time that this person received the order granting her a restricted driving permit, she was arrested for a driving while license revoked charge in a different county. We have to be very careful in a situation like this as any plea to the criminal charge can nullify the result that we obtained with Secretary of State and further could suspend or revoke her license for an additional year or so. To make matters even worse, a plea on the new criminal charge could extend the amount of time that she is eligible for any restricted permit with the Secretary of State. I will keep you posted as to what happens and the specifics of the license laws that apply in a situation such as this.
